Placing an Article 81 petition in the wrong court is a common and costly mistake. Under MHL Article 81, incapacity must be proven by clear and convincing evidence, and the court must impose the least restrictive intervention. Before any filing, we evaluate alternatives to guardianship such as a Durable Power of Attorney (GOL §5-1513) or Health Care Proxy.

Once appointed, a guardian carries ongoing annual reporting duties and must visit the incapacitated person at least four times per year.
